It meant that state laws could not be meddled with by Westminster. Federal laws couldn’t be meddled with after the passing of the Statute of Westminster (UK 1931, Aus 1942).35 Years Birthday Girls 35th Birthday Gift Queen March 1986 Shirt It also, from memory, made appeals to the Privy Council a dead letter constitutional matter, since the Australia Act prohibited issuing the required documentation to get a Privy Council hearing (something the High Court had already stopped issuing). Another big thing it changed was that State Governors ceased to be formally appointed by the Queen on the advice of the UK Foreign and Commonwealth Minister (as successor to the old Colonial Minister) and formally gave this advice roll directly to the Premiers. It had already become convention long before that the British Foreign Minister advise the monarch to appoint whoever the respective Premier told them to advise but this formalised that and removed a key power that the British Government could have potentially used to interfere with the running of Australian state governments.

There’s also a few odds and ends which can’t be done without going back to Westminster. The locking rules used to entrench state constitutions would be legally dubious without a provision in the Australia Act (Imp), because while they’re probably valid without it that would create interesting implications for Westminster (because it would mean that parliament can in fact effectively bind itself, without relying on external punishments to create a similar effect). The other one is that states can’t create courts which aren’t under their Supreme Court, and can’t abolish their Supreme Court, probably not even with a federal constitutional amendment to unify the court systems, without asking Westminster to do it, simply because no-one thought of it at the time. I used to be a staunch Republican, but after reading about the Australia Act a while back I began reconsidering the pro’s and con’s of having the monarchy ‘slightly’ present in the legal affairs of Australia.35 Years Birthday Girls 35th Birthday Gift Queen March 1986 Shirt I would now prefer the status quo. Don’t believe that moving to a Republic would gain us much. I’m somewhere in between too. I like having the ceremonial non-partisan head of state.

When republicanism comes up I’m torn between the two main models, do we wanna keep a ceremonial office who is the physical embodiment of the state (much like the Queen is the physical embodiment of the Crown). Then people complain that it’s undemocratic but if you have elections the office inherently becomes political—moreover, what sort of issues do you debate if you’ll constitutionally have very little authority? The best models to follow through would be the Ireland or the German model. Either way, republic or not, our parliamentary democracy needs to be the primary body of the country. Apart from draining the swamp and a large overhaul of the constitution I agree with not being a republic. 35 Years Birthday Girls 35th Birthday Gift Queen March 1986 ShirtThen again the other things can still happen but not as radically or all at once. We’re vesting executive power of our country into a genetic lottery and the result cannot be changed. In my opinion the only reason the monarchy’s still kicking in Aus is Elizabeth, we’ve all grown up with her, we’re used to her and we trust her, she’s like a grandma. But one day she’ll die and from their it’s just blind faith. It’s a little dangerous if you ask me. Not a boy or girl born in this country is worthy of holding the nations highest office. The fact that people who are supposedly our betters live on the opposite of the earth in our colonisers country, hugely facilitates cultural cringe, a mindset that stifles growth and progress as a nation.
